This is a legal agreement between you, the end user, and Digital Defence Ltd. By installing the software covered by this agreement on your system, you are agreeing to be bound by the terms of this agreement. If you do not agree to the terms of this agreement, please return the entire purchased package to the supplier from whom you purchased it, for a full refund.

This Licence agreement permits you to use the Secure Mobile software product(s) acquired with this Licence on one device for each licence purchased.

The software is owned by Digital Defence Ltd, or its suppliers, and is protected by United Kingdom copyright and associated international treaties and national copyright laws. Therefore, you must treat the software as you would other copyright material (e.g. a book), except that:

a) You may copy the distribution CD(s) onto the main storage medium of your computer for installation.
b) You may copy the original distribution CD(s) or the installed software, as part of your organization’s routine copying procedures for archival or backup purposes only,
c) You may copy the distribution CD(s) onto the main storage of a network server, for installation purposes over a network.
d) You may copy the documentation accompanying the software provided that it is for the use of, and only for the use of, users of your Secure Mobile installation.

In all cases, the total number of devices using the software must not exceed the number of licences purchased.

Use of the software means that all or part of the software is loaded into the main high-speed storage of a device for execution or interpretation by that device’s processor(s) and/or interpretation/emulation programs or subsystems.

You may not rent or lease the software to a third party, but you may permanently transfer your rights under this agreement provided that:

a) The third party agrees to be bound by the terms of this agreement.
b) You transfer all copies of the software (including previous versions) to the third party, together with all documentation, manuals, etc., specifically including this licence certificate.
c) You cease all use of the software, and ensure that any copies on your computers or in archives are destroyed.

5. WARRANTY, REMEDIES, AND CONTINGENT LIABILITIES LIMITED WARRANTY: Digital Defence warrants that the software will perform substantially in accordance with the accompanying product manuals and documentation, and that the distribution CDs will be free of defects for a period of 90 days from the date of receipt. To the maximum extent permitted by law, Digital Defence accepts no other warranty, express or implied, including, but not limited to, implied warranty of merchantability or fitness for a particular purpose, with respect to the software or the accompanying product manuals and documentation.

CUSTOMER REMEDIES: Digital Defence’s entire liability, and your sole remedy shall be at Digital Defence’s option to either

a) Return the price paid for the software, or
b) Replace the software that does not meet the above limited warranty, and which is returned to Digital Defence Ltd with a copy of your receipt (Invoice).

CONTINGENT & CONSEQUENTIAL LIABILITIES: To the maximum extent permitted by law, Digital Defence and its suppliers shall not be liable for any contingent or consequential losses whatsoever, including but not limited to loss of business profits, loss of business information, business interruption, or other financial losses arising out of the use or inability to use the software, or any problems caused by interaction between the software and particular third-party hardware or software.

In the event that any item in this agreement be found invalid by a court of law, or other body of legal jurisprudence, such invalidity shall affect only that item, and will not invalidate the rest of this agreement.

7. LAW 
This agreement is made under the laws of England, and the parties hereto agree to the authority of the English courts.

Nothing in this agreement will act to limit the customer’s statutory rights.

This program suite is protected by copyright. Copying or redistribution other than as covered by the associated licence to use is strictly prohibited.
